The Court emphasised that the Speaker should take into account leadership structures outside of the Legislative Assembly in addition to the Assembly’s numerical majority when making decisions. The Court also encouraged the Speaker to recognise the Whip and Leader lawfully appointed by the political party in accordance with the party constitution and urged a prompt conclusion to the disqualification procedures. In an important development, the Court also referred the issue of whether a Speaker facing removal can rule on disqualification petitions against MLAs under the Indian Constitution’s Tenth Schedule to a larger seven-judge Bench. This action demonstrates the Court’s determination to resolve the intricate problems related to disqualifications thoroughly and quickly.
The Supreme Court’s intervention gives the current political and legal story in Maharashtra context and direction.
