Delhi High Court Refuses to Intervene in NewsClick UAPA Case, CBI Initiates Probe – Flaunt Post
In a recent and significant legal development, the Delhi High Court has refused to intervene in the arrest and subsequent police custody of Prabir Purkayastha, the founder of NewsClick, and Amit Chakravarty, the head of the portal’s human resources department. Their detention is connected to a claim made in accordance with the strict Unlawful Activities (Prevention) Act (UAPA), a law designed to combat terrorism. The court’s judgement, handed out by Justice Tushar Rao Gedela, dismissed the argument objecting to the police action, concluding that Purkayastha and Chakravarty’s petitions lacked validity. On October 3, the Delhi Police’s Special Cell detained both of them.
Purkayastha and Chakravarty appealed their detention and subsequent seven days in police custody to the Delhi High Court after being detained. They asked for immediate release as a temporary solution. However, a trial judge opted to hold them in judicial detention for ten days on October 10. Allegations that they received financial support with the claimed objective of promoting pro-China propaganda—a subject of significant concern under the UAPA—are at the core of this case.
The FIR filed in this case states that significant funds were provided by China with the intent of undermining Indian sovereignty and inciting anti-Indian sentiment. This serious accusation has serious consequences and serves as a symbol of the growing scrutiny and worry about foreign influence in internal politics. Prabir Purkayastha is also charged with conspiring to obstruct the 2019 Lok Sabha elections alongside the People’s Alliance for Democracy and Secularism (PADS), according to the FIR.
An important turning point in this case was Justice Tushar Rao Gedela’s decision to reject the arguments made by the founder of NewsClick and the HR director. It emphasises the court’s position and highlights its conviction that the facts did not support their immediate release. The Delhi police had earlier come under scrutiny from the Delhi High Court for omitting to state the reason for the arrest in the detention application. The case was given more attention as a result of this procedural error.
The Delhi Police detained Prabir Purkayastha and Amit Chakravarty on October 3 as part of a large-scale operation. About 400 police officers got involved in this operation, conducting searches at about 30 different locations in Delhi, Noida, Gurugram, Mumbai, and Ghaziabad. 46 people were interrogated for eight hours during the operation, including writers, journalists, and freelancers.
In a related development, the Central Bureau of Investigation (CBI) started searching NewsClick’s office space and opened an investigation into claims that the news portal had broken regulations governing foreign funding. Following a referral from the Ministry of Home Affairs (MHA), the CBI registered a case under the terms of the Foreign Contribution Regulation Act (FCRA) on October 7. According to a CBI official, the company was suspected of violating FCRA rules by collecting unexplained funds from exports worth 28.46 crores through four foreign organisations. Additionally, it was claimed that 9.59 crore (roughly) in foreign money was received by falsely labelling them as a foreign direct investment (FDI). The private company’s director and other coworkers are accused of breaking the FCRA’s 2010 rules.
The recent Delhi High Court decision marks a turning point in this case, which is far from ending in the legal dispute involving NewsClick’s founder and HR director. The allegations of receiving foreign funds with the intent of spreading pro-China propaganda and disrupting India’s sovereignty are serious and require a thorough examination. The position has been made more difficult by the CBI’s decision to investigate NewsClick, which raises issues about the portal’s business practises. This case will continue to receive media attention as it develops due to the intricate legal issues it raises as well as the larger implications it has for foreign influence in domestic affairs.
