Delhi High Court Clarifies Divorce Grounds and Emphasises Legal Principles in Recent Judgements

Recent decisions by the Delhi High Court have clarified how to interpret grounds for divorce and the significance of following statutory requirements as they relate to divorce proceedings. The legal principles that govern divorce proceedings in India are made clear by these judgements. 

One significant ruling by the Delhi High Court emphasizes that the permanent end of a marriage is not a valid ground for seeking divorce under statutory provisions such as the Hindu Marriage Act, 1955. The court, consisting of Justice Sanjeev Sachdeva and Justice Vikas Mahajan, stressed that Family Courts must strictly adhere to the provisions of the law. In order to achieve complete justice for both parties, the court cited a recent Supreme Court decision in Shilpa Sailesh v. Varun Sreenivasan to emphasise that only the Supreme Court has the authority to grant a divorce based on the permanent end of a marriage. This authority is exercised under Article 142 of the Constitution. The bench argued that High Courts—let alone Family Courts—do not have this authority.

This ruling came in response to a case in which a family court had granted the husband’s divorce petition on grounds of cruelty and desertion while dismissing the wife’s counterclaim for restitution of conjugal rights. The Family Court had acknowledged the absence of conjugal relations and noted that the parties had lived separately for over 11 years, concluding that the marriage had irreparably broken down. However, the Delhi High Court overturned this judgement, claiming that the Family Court had exceeded its authority. The court emphasised that the length of separation is simply one of several considerations that the Supreme Court takes into account when exercising its discretionary authority under Article 142 of the Indian Constitution. The Delhi High Court therefore found it unlawful for the Family Court to grant a divorce based only on the lengthy separation.

In another ruling, the Delhi High Court upheld a divorce granted to a couple whose marriage had only lasted 35 days owing to non-consummation and reaffirmed that a spouse’s purposeful rejection of a sexual relationship constitutes cruelty. When rejecting the wife’s appeal against the divorce judgement issued by the family court, a bench presided over by Justice Suresh Kumar Kait cited an earlier high court decision that stated “marriage without sex is anathema” and “nothing is more fatal to a marriage than disappointment in the sexual relationship.” The wife’s opposition prevented the marriage from being consummated, and the court noted that she had previously filed a dowry harassment complaint with insufficient supporting documentation. This was also viewed as a harsh act.

The bench remarked that in a precedent case, the high court had stated that deliberate refusal by one spouse to engage in a sexual relationship amounts to cruelty, particularly when the couple is newly wed, and such conduct alone can serve as a valid basis for seeking a divorce. The court emphasised that such deprivation lasting more than 18 years constituted mental cruelty in this particular circumstance.

The couple married in 2004 following Hindu customs and rituals, but the wife returned to her parental home shortly after the wedding and did not come back. The husband subsequently sought a divorce in the family court on grounds of cruelty and desertion. In its verdict, the court stated that the family court “rightly concluded” that while the desertion ground was not proven, the wife’s conduct towards the husband constituted cruelty, entitling him to a divorce decree.

These recent decisions of the Delhi High Court highlight the relevance of adhering to statutory requirements and legal principles in divorce procedures and offer crucial insights into the interpretation of reasons for divorce. They provide helpful direction to courts, attorneys, and people through the difficulties of divorce in India.
